These Terms of Service (“Terms”) govern your access to and use of the KALCHA website, products, and related services (collectively, the “Services”).
Throughout these Terms, “KALCHA,” “we,” “us,” and “our” refer to the operator of KALCHA. “You” and “your” refer to users, visitors, and customers of the Services.
By accessing our website or purchasing from us, you agree to these Terms and any policies referenced in them, including our Privacy Policy and Return & Refund Policy.
If you do not agree to these Terms, please do not use the Services.
Our online store is hosted by Shopify, which provides the ecommerce platform through which we offer our products.
1. ONLINE STORE TERMS
By using the Services, you represent that you are legally capable of entering into these Terms or are using the Services with the authorization of a parent or legal guardian where required by law.
You may not use our Services or products for any unlawful or unauthorized purpose or violate applicable laws while using the Services.
You must not transmit viruses, malicious code, or other technology intended to interfere with the operation or security of the Services.
We may suspend or terminate access to the Services for violations of these Terms.
2. PRODUCTS
We make reasonable efforts to accurately display and describe our products.
However, colors, proportions, appearance, packaging, and other visual characteristics may vary slightly because of screen settings, manufacturing processes, printing, photography, or other factors.
Product availability and quantities may be limited.
We reserve the right to modify or discontinue products, change product descriptions, and change prices at any time without prior notice, subject to applicable law.

3. ORDERS
We reserve the right to accept, reject, limit, or cancel an order where reasonably necessary, including in cases involving:

- Product or inventory availability
- Suspected resale or abusive purchasing activity
- Shipping restrictions

If we cancel an order after payment has been collected, we will issue any refund required for the canceled portion of the order.

Prices are displayed in the currency indicated on the website and may change without notice.
Taxes, shipping charges, duties, or other charges may apply depending on your order and destination and will be presented or handled as applicable.
Payment is processed through Shopify and/or payment providers available at checkout.
We reserve the right to correct pricing, promotional, or listing errors as permitted by applicable law.
5. SHIPPING AND DELIVERY
Delivery estimates are estimates and are not guarantees unless expressly stated otherwise.
KALCHA is not responsible for delays caused by circumstances outside our reasonable control, including carrier delays, customs processing, weather, transportation disruptions, or incorrect shipping information supplied by the customer.
Customers are responsible for providing an accurate and complete delivery address.
Our Shipping Policy, where provided, contains additional information regarding shipping and delivery.
6. RETURNS, REFUNDS AND FINAL-SALE PRODUCTS
Returns, refunds, replacements, exchanges, and final-sale products are governed by our Return & Refund Policy.
Certain products, including masks and wearable head coverings, may be designated final sale for hygiene reasons, except for damaged, defective, or incorrect products and except where applicable law provides otherwise.

7. INTELLECTUAL PROPERTY AND RIGHTS
KALCHA respects the intellectual property and other legal rights of artists, creators, brands, individuals, and other rights holders.
Certain products or creative works offered through KALCHA may reference or depict elements of popular culture, music, artists, or other publicly recognizable subject matter.
Unless expressly stated otherwise, KALCHA is not affiliated with, endorsed by, sponsored by, or officially connected with any artist, performer, record label, entertainment company, brand, or other third party referenced in connection with such products.
Nothing on the Services should be interpreted as claiming ownership of third-party intellectual property where such ownership does not exist.
If you are a rights holder or an authorized representative and believe that material or a product appearing through the Services infringes your copyright, trademark, publicity, privacy, or other rights, please contact:

8. KALCHA BRAND AND WEBSITE CONTENT
Except for third-party material and other content expressly identified otherwise, the KALCHA name, branding, website design, original graphics, original photographs, written content, logos, and other original materials created for KALCHA are owned by or licensed to KALCHA and are protected to the extent provided by applicable law.
You may not reproduce, distribute, commercially exploit, or create unauthorized copies of KALCHA-owned content without permission.
Nothing in this section claims ownership over intellectual property belonging to third parties.
9. USER CONTENT AND FEEDBACK
If you submit reviews, photographs, comments, feedback, or other content to us, you represent that you have the necessary rights to provide that material.
You must not submit content that infringes another person's intellectual-property, privacy, publicity, or other rights or that is unlawful, fraudulent, abusive, or malicious.
Where you intentionally submit content for publication or promotional use, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and adapt that content for operating and promoting KALCHA, subject to applicable law.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KALCHA AND ITS OWNERS, AFFILIATES, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS.
Where liability cannot legally be excluded, our liability will be limited to the maximum extent permitted by applicable law.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
16. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless KALCHA and its owners, affiliates, employees, contractors, and service providers from third-party claims arising from your unlawful misuse of the Services, your violation of these Terms, or your infringement of another person's rights.

We may suspend or terminate your access to the Services if you materially violate these Terms or where necessary to protect KALCHA, our customers, or third parties.
Provisions that by their nature should survive termination will continue to apply.

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary.
The remaining provisions will continue in effect.
19. NO WAIVER
Our failure to enforce a provision of these Terms does not waive our right to enforce that provision later.
20. ENTIRE AGREEMENT
These Terms and the policies referenced in them constitute the agreement governing your use of the Services and supersede prior versions relating to the same subject matter.
21. GOVERNING LAW
These Terms are governed by the laws applicable in the State of California, United States, without regard to conflict-of-law principles, except where mandatory consumer-protection laws in your jurisdiction provide otherwise.
Nothing in these Terms deprives consumers of protections or rights that cannot lawfully be waived.
22. MARKETING COMMUNICATIONS
If you separately elect to receive marketing communications from KALCHA, we may send promotional emails or, where offered and properly consented to, text messages.
You may unsubscribe from marketing emails using the unsubscribe link provided in those communications.
Where SMS marketing is offered, applicable consent disclosures, message frequency information, carrier-rate disclosures, and opt-out instructions will be provided when consent is requested.
Consent to receive marketing communications is not a condition of purchasing unless expressly permitted by applicable law.
We may continue to send transactional communications regarding orders, payments, shipping, account security, or customer-service matters regardless of your marketing preferences where permitted by law.

We may update these Terms periodically to reflect changes to our Services, practices, legal requirements, or operations.
